1. Who you are contracting with
Cookie Golf Studios Limited, a company registered in Scotland with company number SC907645, whose registered office is at 45 King Street, Stirling, FK8 1DN. In these terms "we" and "us" means Cookie Golf Studios Limited, and "you" means the person buying the founding membership.
Contact us at [email protected].
2. What a founding membership is
A founding membership costs £299, paid once. There are 100 available. When they are gone, they are gone.
It gives you, for twelve months from the day the studio opens:
- One peak bay-hour and one off-peak bay-hour every month, 24 hours across the year
- Three guest passes, as set out in clause 5
- 15% off any additional hours you book during those twelve months, the same discount our Standard members receive
How you pay. You pay by bank through GoCardless, our payment provider. When you join, GoCardless takes the £299 and also sets up a Direct Debit with your bank, in favour of Cookie Golf Studios.
The founding membership is still a single payment of £299. We will not collect anything else using that Direct Debit unless you have agreed to it first, for example by choosing to join a monthly membership after your twelve months (clause 11). If you do agree to a further payment, you will be told the amount and the date before it is taken, as the Direct Debit Guarantee requires.
You can cancel the Direct Debit at any time by contacting your bank or GoCardless. Doing so does not cancel or affect your founding membership. Every Direct Debit payment is covered by the Direct Debit Guarantee.
3. When it starts
Your twelve months start on the day the studio opens to the public, not on the day you pay. You are buying a membership that begins when we open. We will email you the opening date as soon as it is fixed.
4. Your hours each month
- You get one peak hour and one off-peak hour each month. Peak is evenings and weekends. Off-peak is weekdays before 5pm
- Hours are granted monthly and do not roll over. Anything unused at the end of a month is gone
- Hours are booked the same way as any other session and are subject to availability
- A bay takes up to four people and your hour covers the whole bay, so you can bring three people with you at no extra cost
- We may apply a fair-use rule if the way hours are being used makes the studio unworkable for other people. We will tell you before we do
5. Guest passes
You get three guest passes. Each one is a free off-peak bay-hour that you can give to someone who has not been to Cookie Golf Studios before.
- They are for giving away, not for using yourself
- They are separate from your own hours and do not come out of your monthly allowance
- They are valid for three months from the day we open
- One pass per person, and the person using it must be 18 or over
6. The membership is yours
A founding membership belongs to the named person who bought it. To use your hours, the booking must be in your name and you must be there.
You can bring up to three people with you on your hour at no extra cost. What you cannot do is share the membership itself, or lend your hours to somebody else to use without you. If you want to pass the whole membership on permanently, clause 10 covers that.
7. If we do not open
We hold every founding membership payment in a separate bank account. We do not spend it on the fit-out, or on anything else, before we open.
If we have not opened to the public by 31 December 2027, you are entitled to a full refund of £299. We will contact everyone who has paid and arrange it. You do not have to chase us.
We may extend that date once, by up to six months, if opening has been delayed. If we do, we will write to you, tell you the new date and the reason, and give you 30 days to ask for a full refund instead. If you do nothing, your membership continues to the new date.
8. If what we open is different
The founding membership is sold on the basis of a studio in the Stirling area. If that changes materially before we open, and in particular if we open in a location materially further from Stirling, we will write and tell you, and you may have a full refund if you no longer want the membership.
9. Your right to cancel
You have a legal right to cancel within 14 days, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
That period runs from the day after you buy, not from the day we open. You will receive a cancellation form with your confirmation email, and you can also simply email [email protected] and say you want to cancel. We refund within 14 days of being told, to the bank account you paid from.
After those 14 days, your refund rights are the ones in clauses 7 and 8, and the transfer right in clause 10. Nothing in these terms removes or reduces your statutory rights.
10. Transferring your membership
You may transfer your founding membership to another person, before or during the twelve months.
Email [email protected] with your name, and the name and email address of the person taking it over. A transfer only takes effect once we have confirmed it in writing. The new member must be 18 or over and takes on these terms.
We do not charge for a transfer. Whatever you agree with the person taking it over is between you and them, and we are not involved in any payment between you.
11. What happens after twelve months
Your founding membership runs for twelve months and then ends. It does not renew and it does not roll into anything automatically.
Before it ends we will offer you one of our monthly or annual memberships, at the prices in force at that time. You are under no obligation to take one, and we will not take any money from you using your Direct Debit unless you agree to join. If you do nothing, your founding membership simply ends and you can carry on booking sessions as a non-member.
12. If we have to change these terms
We may change these terms where the law requires it, or for a good reason that we explain to you. If a change puts you at a material disadvantage we will tell you first, and you may have a full refund of any unused part of your membership.
13. Our liability
We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms, or of us failing to use reasonable care and skill.
We do not exclude or limit our liability where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, and liability for fraud.
We are not liable for business losses. A founding membership is supplied for private use.
14. Complaints and the law that applies
Tell us first: [email protected]. We reply within five working days.
These terms are governed by the law of Scotland, and the Scottish courts have jurisdiction.
Your personal data is handled as set out in our privacy notice.
